Terms of Service
Our concierge nursing services are designed to support your overall wellbeing and personalized care but do not replace consultation with a licensed healthcare provider or emergency medical services. In case of a medical emergency, please call 911 immediately. Joyce is a licensed registered nurse in Michigan. This is a private-pay service and Oncology Nurse Concierge, LLC does not accept insurance.
You do not need a physician referral to receive concierge nursing services. However, we’re always happy to coordinate with your healthcare providers to ensure seamless, well-rounded care and support your overall health goals.
The goal is to have Joyce as an advocate and the “family member in the room” who happens to be a physician. We are adjuncts to care, but your treatment will be recommended by the experts in the field.
Scope of Services
The consultant agrees to provide personalized, non-medical consulting and advocacy services to the Client which may include:
Reviewing existing medical records and treatment options.
Facilitating communication and coordinating with existing medical teams.
Researching clinical trials, second opinions, and specialized treatment facilities.
Providing personalized education and guidance on oncological terms and pathways.
Services do not include providing medical diagnosis, prescribing medication, or serving as a substitute for the Client’s primary medial team.
Term and Termination
This Agreement shall commence on the Effective Date and continue unless terminated earlier as provided herein. Payment for services is due before services rendered. This payment is non-refundable. Either party may terminate this Agreement at any time by providing the other party with notice. Upon termination, the Consultant shall be paid for all services performed up to the termination date. Either party may terminate this Agreement immediately upon notice if the other party breaches any material term of this Agreement.
Fees and Payment
The Client agrees to pay the Consultant a fee based on agreed upon consultation hours of service after initial free consultation. A monthly retainer may be applicable for up to four total (non-consecutive) hours of service by the Consultant.
Fees and payment are collected by cash, check, or through the Consultant’s Zelle account.
The Consultant shall submit invoices upon agreement of services and payment is due upon receipt of the invoice.
Relation of Parties
The Consultant is an independent contractor and nothing in this Agreement shall be construed as creating an employer/employee, partnership, or joint venture relationship. The Consultant shall be solely responsible for all taxes and contributions payable with respect to the compensation paid hereunder.
Confidentiality and HIPAA Compliance
Confidentiality: The Consultant acknowledges that they will have access to sensitive personal and health information (PHI). All such information is strictly confidential.
Non-Disclosure: The Consultant agrees not to disclose, divulge, or use any of the Client’s PHI or confidential information without the Client’s prior written consent, except as required by law.
Medical Disclaimer: The Consultant is not a healthcare provider for the purposes of rendering medical care and this Agreement does not constitute a Business Associate Agreement under HIPAA. The Consultant’s role is strictly advisory and supportive.
Limitation of Liability
The Consultant makes no guarantees, expressed or implied, that the Services will result in a specific outcome (e.g., cure, recovery, specific treatment approval). The Consultant’s total liability for any and all claims arising out of or in connection with this Agreement shall be limited to the total fees paid by the Client to the Consultant for the services provided.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
Acceptance
